What information does this Privacy Policy cover?
Except as specifically described below, this Privacy Policy applies only to personally identifiable information collected on the Web sites where this Privacy Policy is posted and does not apply to any other information collected by Merlin’s Code through any other means.
As used in this Privacy Policy, "Merlin’s Code" refers to Esther Penner dba, Merlin’s Code and its subsidiary and affiliated entities, singly or together, Merlin’s Code is referred to in this Privacy Policy as "Merlin’s Code" "we," "us," "our," and "ourselves."
When this Privacy Policy uses the term "personally identifiable information," we mean information that identifies a particular individual, such as the individual's name, postal address, e-mail address, and telephone number. When other information (such as, for example, consumer product preferences or number of children) is directly associated with personally identifiable information, this other information also is treated as personally identifiable information for purposes of this Privacy Policy. Personally identifiable information does not include screen names (also known as member names, usernames or other online aliases) provided by our guests in the course of registering with or using any of our Web sites, except in circumstances in which we request that guests provide their e-mail addresses as their screen names. Personally identifiable information is sometimes referred to in this Privacy Policy as "personal information." Finally, the terms of this Privacy Policy are subject to all applicable laws.
What types of personally identifiable information do we collect?
In order to provide certain services to its members and guests, Merlin’s Code must collect, use, and share certain information about you. The data that Merlin’s Code collects and maintains is as follows:
A. Information that you provide to us.
Merlin’s Code receives and may store some or all of the information that you enter on our Sign-up pages. Typically, this stored information may include the user’s name, postal address, e-mail address, and telephone number. The information may include:

If you purchase products or services from us we may likely store, for example, the type of services or products ordered or purchased, and the date of the order or purchase. Typically, such information also includes your e-mail address, first name, last name, address, city, state, zip, country, your username and password, and your agreement to be bound by Merlin’s Code’s Website Code of Conduct and Privacy Policy.
Payment Information
Payments for our products and services are being processed through our PayPal merchant account. After selecting the appropriate learning module and the Session the purchaser is directed to the PayPal website where the process is completed. The purchaser's contact information will be recorded on our Merlin's Code account but not your method of payment.
Other Information
We may also collect other types of information such as the squire's or user’s gender, age, and personal interests, which we may associate with personally identifiable information. You may also provide us photographs or other video materials, which may contain personal information. We may collect personal information when you register on, log on, or visit our Web sites, including when you participate in activities on our Web sites, such as the Learning module(s) ordered, the tasks and sessions completed, blog comments, test scores, contests, games, and informational and promotional offers, and when you provide information to our customer service representatives, mentors and/or via our Questions and Comments page. In addition, our Web sites may offer message boards, conversation pages, chat rooms, social community environments, profile pages, and other Public Forums, as well as other features in which you may provide us with User Submissions. If you provide personal information when you use any of these features, that personal information may be publicly posted and otherwise disclosed without limitation as to its use by a third party.
B. Information that we automatically receive
Merlin’s Code receives and may store certain information whenever you download web pages, complete sessions, or send us e-mail or forms.
For example:
1. We identify the numerical IP address assigned to your computer by your Internet Service Provider. An IP address is associated with the access point through which you enter the Internet, and is typically controlled by your Internet Service Provider (ISP), your company, or your university. Standing alone, your IP address is not personally identifiable. We may use IP addresses to collect information regarding the frequency with which our guests visit various parts of our sites, and we may combine IP addresses with personally identifiable information.
2. E-mail Correspondence: Merlin’s Code may request certain confirmations when you receive, transmit, and open any e-mail communications and when you participate in chat rooms, instant messaging and other communications with users of the service and Merlin’s Code’s mentors. Although we may or may not actually store such information, we reserve the right to archive all e-mails, instant messages and other communications sent in and out of our network, and we may identify the origination IP address of all mail sent into our network. We require that you refrain from "forging headers" or sending "SPAM".
3. Our Web sites may also collect information through a variety of technical methods, including cookies and Web beacons. Cookies are pieces of information that a Web site sends to your computer while you are viewing the Web site. Web beacons are small pieces of data that are embedded in images on the pages of Web sites. Cookies, web beacons and other technical methods may involve the transmission of information either directly to us or to another party authorized by us to collect information on our behalf.
We may use the information collected through these technical methods for many purposes, including delivering content, tracking and enhancing our user’s experience on our Web sites. For example, when you return to one of our Web sites after logging in, cookies provide information to the site so that the site will remember who you are. We also may use technical methods to analyze the traffic patterns on our Web sites, such as the frequency with which our users visit various parts of our Web sites, and third party Web sites, such as the frequency with which our users visit other Web sites. In HTML e-mails that we send our members, users and guests, we may use technical methods for a number of purposes, including: to determine whether the recipients have opened or forwarded those e-mails and/or clicked on links in those e-mails, and to determine whether a member, user or guest has made an inquiry or purchase in response to a particular e-mail. These technical methods may enable us to collect and use information in a form that is personally identifiable.
C. Information from third parties
From time to time, Merlin’s Code may request and receive information from third parties and compare it to the information that you have provided. The main purpose for this is loss prevention and to protect our user’s from unwarranted third party intrusions by persons who are not authorized to use the service.
In addition, we may obtain personally identifiable information about individuals who are not yet users of our Web sites. In addition, when we associate information that we obtain from third with personally identifiable information that we have collected under this Privacy Policy, we will treat the acquired information like the information that we collected ourselves and, except as permitted by this Privacy Policy, the information will not be shared with third parties.
How is your personally identifiable information used and shared?
Other than the carefully crafted exceptions intended only to facilitate the service and protect its members, Merlin’s Code will not share any personally identifiable information with any third parties. Indeed, other than as expressly stated herein, Merlin’s Code will only release data when we believe the release is appropriate to comply with the law, enforce our Agreement, and protect the rights of our staff, Mentors and/or Member users.
From time to time, Merlin’s Code may use your personal information to send you promotional materials about goods and services (including special offers and promotions) offered by Merlin’s Code. These promotional materials may be sent to you by postal mail, e-mail or other means. You may opt out of receiving such promotional communications. If you permit Merlin’s Code to send you promotional materials, you may withdraw the permission by e-mailing us at inquiries@merlinscode.com.
From time to time we may also use your information to complete transactions requested by you (such as your purchase of a product or service offered on our Web sites), or to send you administrative communications either about your account with us or about features of our Web sites, including any future changes to this Privacy Policy.
Companies That Facilitate Communications and Transactions with You
Sometimes Merlin’s Code may hire companies to help provide products or services, like a shipping company that delivers a package or a company that helps fulfill prizes for a contests. In those instances, there is a need to share your information with these companies. Sometimes Merlin’s Code also works with other companies who help either gather your information or communicate with you, such as a company that helps to provide customer service.
